What is contributory negligence?
Contributory negligence is the older form of comparative negligence. In many districts, it has been completely eliminated in favor of comparative negligence. Contributory negligence once acted as a complete bar to recovery in the event that it could be proven that the plaintiff played a role in his or her own injuries. Considering that it didn’t take into account how minor the plaintiff’s actions might have been in the actual accident, many courts and individuals felt that this idea was inherently unfair.
