Fault is typically determined by the officer that writes up the accident report at the scene. The officer will generally determine fault by taking witness statements and driver statements. This tells him or her what happened and gives him or her an idea of what traffic rules were broken. Some cases are easier than others to determine fault but the officers can generally figure it out.
