How does comparative negligence work?
Comparative negligence is a defense used by the defendant in a negligence suit in an attempt to shift some of the blame from the defendant to the plaintiff for the injuries that occurred. Here, the actions and fault of the defendant are compared to those of the plaintiff. In strict comparative liability cases, the plaintiff may recover the percentage of damages that corresponds to the defendant’s negligence, regardless of how much the injuries were affected by the plaintiff’s own actions.
