How are damages paid out?
Damages are paid depending on a couple of factors. In cases where the individual has an insurance company backing his or her liability, such as in car accidents, medical malpractice, or premises liability cases, the insurance company is likely to pay out to cover the damages. If there is not an insurance company involved, like in battery or other intentional tort cases, the damages awarded come from the pocket of the defendant that was found to be at fault.
