How are damages awarded?
Damages are awarded based on the injuries sustained, the medical bills paid, and the judgment of the jury. If the jury is sympathetic to the plaintiff, it may choose to award more damages for incidentals like emotional distress or pain and suffering. In addition to the awards from the jury, the judge may want to punish the defendant for his or her exceptionally heinous activities and may award punitive damages.
