A San Francisco jury returned a $41 million verdict in a personal injury lawsuit filed by a plumber who was diagnosed with mesothelioma in January 2011.
The lawsuit was filed by Jake Casey against Kaiser Gypsum Company, Inc, a manufacturer of wallboard materials and joint compounds. According to court documents, the lawsuit alleged that asbestos contained in the compounds and wallboards were defectively designed and failed to warn of the potential risks of asbestos exposure.
The jury determined that Kaiser Gypsum acted with oppression and malice and failed to warn workers that asbestos exposure could cause mesotheliorma or cancer. The jury also determined that the company failed to protect workers from asbestos dust and fibers.
