Sharon Stone Named in Premises Liability Lawsuit

A premises liability lawsuit has been filed against actress Sharon Stone.

According to court documents, the slip and fall lawsuit was filed by Peter Krause. Krause claims he slipped and fell on the actress’ property in 2006, suffering internal injuries. He is seeking unspecified damages based on negligence and premises liability. Krause says he slipped in Stone’s backyard while doing some landscaping work.

If the court sides with Krause, Stone could be held liable for medical costs as well as pain and suffering.

The trial is set to begin Tuesday afternoon in Los Angeles. Sharon Stone is on the witness list and will be the first to testify.  A representative of the State Compensation Witness Fund is also expected to testify.

Man Injured in Harrisburg ATV, Van Accident

A man was injured in a Harrisburg ATV accident Saturday evening.

According to the Harrisburg Police Department’s accident report, a man was riding an ATV on a busy city street at a high rate of speed and crashed into a van at the intersection of North 19th and Miller Streets shortly after 6:45 p.m. Witnesses said the man was standing while he was recklessly driving the ATV and hit a van that was turning west onto Miller Street.
Authorities say the ATV rider was ejected from the vehicle in the crash, struck the van’s windshield, bounced over the top of the van, and landed in the center of the roadway.

The 23 year-old rider was transported by ground ambulance to the Hershey Medical Center for treatment. He was listed in serious condition Saturday night. He is expected to make a full recovery. The van driver, a man from Duncannon, was not injured in the accident.

The accident remains under investigation by the Harrisburg Police Department.

Harrisburg Driver Error Accident Injures 3

Three people were injured in a Harrisburg car accident Wednesday afternoon.

According to officials with the Harrisburg Police Department, the accident occurred shortly after 3:00 p.m. at the intersection of Old Route 13 and St. Mary’s Drive. Police say 16 year-old Rayna E. Johnson was driving with a 15 year-old passenger on St. Mary’s drive when she exited into the path of a truck driving west on Old Route 13. The truck, driven by Gary D. Reeder, was pulling a boat and could not be stopped in time. The truck collided with the driver’s side door of Johnson’s vehicle.

Firefighters extricated Johnson from her vehicle and she was transported by ground ambulance to Harrisburg Medical Center where an emergency medical helicopter was waiting, according to Harrisburg Police Chief Bob Smith. An ambulance also took the 15 year-old passenger to Harrisburg Medical Center.

Reeder received a minor hand injury in the car accident, Smith said, and was also taken to the hospital.

15 Children, 8 Adults Injured in Harrisburg Bus Accident

Fifteen children and eight adults were injured in a school bus accident in Harrisburg Sunday.

According to officials with the Pennsylvania State Police, the bus, carrying 22 people, was on its way to a children’s camp when the accident occurred. Authorities say the accident took place when the driver of a Cadillac attempted to pass the bus, failing to see oncoming traffic. The driver, 79 year-old Hagerstown-resident Edward Shaffer, overcorrected and ended up in the path of the bus.

Police say the force of the crash caused the bus to roll over. Emergency crews extricated three children who were pinned in the bus, according to the accident report. Shaffer was also extricated from his car.

Everybody on board the bus was transported by ground ambulance to an area hospital with injuries ranging from minor to moderate. Shaffer was also taken to the hospital for treatment, police said.

Man Killed in Harrisburg Motorcycle Accident

A man was killed in a Harrisburg motorcycle accident Friday night.

According to officials with the Harrisburg Police Department, the motorcycle accident occurred shortly after 11:00 p.m. at the intersection of Greenwood Street and South 19th Street. Police say a 37 year-old motorcyclists was traveling west on Greenwood Street and failed to yield to oncoming traffic at a stop sign at the intersection of South 19th and was struck by a pickup truck.

According to the accident report, the 37 year-old motorcyclist sustained severe internal injuries in the crash. He was transported by ground ambulance to a Harrisburg Hospital, where he was pronounced dead a short time later. His name has not been released.

The motorcycle had been reported stolen in North Middleton Township last April, according to police. Investigators have not determined who stole the motorcycle, or who was at fault in the accident.

Settlement Reached in Wal-Mart, McDonalds Slip and Fall Lawsuit

A final judgement has been entered in a premises liability lawsuit filed against McDonalds and Wal-Mart last Augst.

The slip and fall lawsuit was filed by Cheryl Gilpatrik, of Dallas, Texas, in Jefferson County District Court on August 9, 2010. According to the lawsuit Gilpatrick was shopping with her friend at the Orange Wal-mart on April 1, 2010, when she slipped on spilled soda left on the floor near the soda bin outside of a McDonald’s restaurant inside the Wal-Mart.

“According to witnesses at the scene, several of the Wal-Mart employees were working in the area at the time and at least one of the made comments that she actually saw a customer spilling soda out of the cup while walking away from the coke bin,” the lawsuit said. “However none of the Wal-Mart employees took action to either promptly clean up the spill, warn customers about the spill, cordon off or barricade the area and/or perform any of the required preventative actions before the Plaintiff slipped and fell on it.”

On March 16, a final judgment was entered in the case, which showed that both Wal-Mart and McDonalds elected to settle the lawsuit rather than continue with litigation.

Premises Liability Lawsuit Filed Over CA Hiking Death

The family of a man who slipped and fell to his death off a cliff near Yosemite National Park have filed a premises liability lawsuit against the state of California.

According to court documents, Christopher and Lisa Broderick claim their son, Ryan, died because of a “concealed trap” that was negligently maintained by the State. The premises liability lawsuit was filed against California, the state Department of Transportation, Caltrans, Mariposa County, The Fischer Family 1993 Trust, and The Prange Trust.

Ryan Broderick died on April 30, 2010. While en route to Yosemite, Broderick stopped along Highway 140 to look at scenery. At the end of a culvert, which extendes above a rocky area below, Broderick lost his footing on the wet concrete and fell 50. He was pronounced dead at the scene by the Mariposa Sheriff’s Department.

The lawsuit claims the property had “latent and concealed perils,” and that Ryan was “not aware of the dangers.” Broderick’s parents contend that California and the other defendants “owed a duty to the general public” to “maintain the . . . property in a reasonably safe condition.”

$41 Million Verdict in Workplace Injury, Mesothelioma Lawsuit

A San Francisco jury returned a $41 million verdict in a personal injury lawsuit filed by a plumber who was diagnosed with mesothelioma in January 2011.

The lawsuit was filed by Jake Casey against Kaiser Gypsum Company, Inc, a manufacturer of wallboard materials and joint compounds. According to court documents, the lawsuit alleged that asbestos contained in the compounds and wallboards were defectively designed and failed to warn of the potential risks of asbestos exposure.

The jury determined that Kaiser Gypsum acted with oppression and malice and failed to warn workers that asbestos exposure could cause mesotheliorma or cancer. The jury also determined that the company failed to protect workers from asbestos dust and fibers.

Driver Dies in Harrisburg Car Accident

A man was killed in a Harrisburg car accident Tuesday afternoon.

According to officials with the Schuylikill County Sheriff’s Department, 45 year-old Norman Tuttle was pronounced dead at the scene of a two vehicle accident on Route 125 in Eldred Township. Deputies said Tuttle was traveling north on Route 125 in a tractor-trailer transporting a load of potatoes. He was driving too fast to safely negotiate a right-hand turn in the roadway, causing the rear portion of his tractor-trailer to collide with another vehicle, deputies said.

According to the accident report, the other vehicle, driven by 52 year-old Carl Adams, was transporting bales of hay. The tractor-trailer knocked Adams’ vehicle onto its passenger side, deputies said. The tractor-trailer then fell onto its driver’s side and slid off the roadway into an embankment.

Adams was transported by ambulance to Schuylkill Medical Center South for treatment of a minor injury.

VA Medical Center sued for botched radiation

The Philadelphia VA Medical Center and Dr. Gary Kao are being sued by five former patients for botched radiation therapy.

Five veterans and former cancer patients, Richard Mitchell, James Armstrong, Barry Lackro, Donald Pepper, and John Berry, that were treated by Dr. Kao at the Philadelphia VA Medical Center believe they received improper treatment for their cancer.  Dr. Kao performed a therapy called brachytherapy on all five patients.

Investigators from the U.S. Nuclear Regulatory Commission looked into the hospital and Dr. Kao’s practices and determined that of 114 patients receiving brachytherapy, Dr. Kao only performed the procedure correctly 16 times.   Furthermore, the NRC found that staff at the cancer unit often tried to cover up mistakes in medical records.  Dr. Kao was terminated from his position and the cancer unit at Philadelphia VA Medical Center was closed down.
