A wrongful death lawsuit has been filed against the Toyota Motor Corporation on behalf of a University of Pittsburgh student that died in a single car crash in 2007.
The lawsuit, filed in Los Angeles, alleges that the 2007 Yaris hatchback that 21 year-old Tyrene Livingston was driving two years ago had a defect in its electronic acceleration system. Livingston reportedly told the dealership, four days before the fatal accident, that she believed her brakes were not working properly. Mechanics checked her vehicle and claimed there were no problems.
As Livingston was driving the car on October 26, 2007, the vehicle careened across three lanes of highway traffic, crashing through a concrete barrier into the woods. Livingston was pronounced dead at the scene. The lawsuit, filed by Livingston's mother, contends, "The troubled carmaker should have provided a mechanical linkage between the accelerator and the engine or a way for the brake to override the system"
