- The presence of a duty. Legally speaking, everyone has an obligation to act in a way that will prevent other people from coming to harm.
- The breach of a duty. The person who allegedly caused your injury must have broken his or her duty.
- An injury. You must have been injured in some way.
- Proximate cause. The breach of duty must have led more or less directly to your injury. That is, the person who breached his or her duty must be responsible for your injury.
